 From experience on other projects, my feeling is that it's a really  
bad idea to interrupt the download process with an EULA step.  It  
sends away a large percentage of "lemme just try out this out" type of  
downloaders.  The user experience "feels" wrong when this is done  
because it is so unusual.

I support letting users know about the software-update check, which  
can be used as a callback.  But I think it's even better to not worry  
about it, and place the info perhaps into the faq.  Software update  
services are pretty standard now and well-enough understood that  
people are happy to have it run, and have it on by default, as long as  
it's possible to shut it off.
